The “Capital Apartments EDify Contest” (the “Contest”) is brought to you by Capital Capital Corp., (the “Contest Organizer”). The Contest runs across Alberta, from October 1, 2020 at 12:00AM MT to October 31, 2020, at 12:00AM MT (the “Contest Period”).
This Contest is open to residents of Canada who have reached the age of majority, who can provide a valid email address; and who can provide a valid mailing address in Canada. Void where prohibited. In order to participate in the Contest, each participant must comply with all Contest Rules and regulations at all times.
The Contest winner will receive one credit of six (6) months base rent that can be applied against any twelve (12) month lease with a commencement date before January 1, 2021 entered into in the name of the Contest winner in respect of the Capital building located at 10043 108 St NW Edmonton, AB (the “Building”) having an approximate value of $7374 – $14394 (the “Prize”). The awarding of the Prize does not entitle the winner to be approved for a lease in the Building or otherwise compel the Contest Organizer to lease a unit in the Building to the Contest winner. The Contest winner is solely responsible for all costs not expressly described herein. The Prize must be accepted as awarded. The Prize may not be sold, transferred and is not convertible to cash.
How to Enter
No purchase necessary to enter. To enter, you must (1) attend a tour of the Building with the Contest Organizer’s representative; (2) properly complete an entry form; (3) deliver the properly completed entry form to Contest Organizer’s representative at the Building before the end of the Contest Period; and (4) otherwise comply with the eligibility criteria set out in the Contest Rules. One entry per person. By submitting an entry form, you confirm that you have read and agreed to comply with the Contest Rules.
Winner Selection and Notification
The Contest Organizer will monitor all entries and choose a winner from the participants who entered the Contest by selecting the winning entry form at random at the end of the Contest Period in accordance with these Contest Rules. The first entry drawn will be eligible to win the Prize. For the purposes of the Contest Rules, the entrant is the person whose personal information is printed on the entry form. It is to this person that the Prize will be awarded if they are selected and declared a winner.
Within two (2) business days after a draw, the Contest Organizer, acting reasonably, will attempt to contact the potential Prize winner at the email address and telephone number provided on the entry form to notify a potential winner that he or she may have won the Prize. Winning entries may be posted by the Contest Organizer to all Strategic Group social media accounts and used in other marketing materials. Entry into this Contest represents the participants’ express permission to do so.
In the event that a potential winner is ineligible under the Contest Rules; fails to collect his or her prize in accordance with the Contest Rules; or fails to follow instructions provided by the Contest Organizer; or refuses to collect the prize, the potential winner will forfeit the right to collect the Prize, the Contest Organizer will continue to select entries at random until an eligible participant is chosen as a winner; provided that, after three random draws, the Contest Organizer reserves the right, in its sole and unfettered discretion, to withdraw the Prize entirely, with no further obligation to award such Prize in any additional draws.
The provisions and procedures referred to above relating to selection and notification of a potential winner, shall be applied, with the necessary amendments, until a qualified winner has been duly selected, but in any event, no later than November 30th, 2020.
In the event that the potential winner cannot be contacted within two (2) business days after the draw, he or she will be disqualified. Proof of identification must be provided upon request. In order to be declared the winner, the potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by the Contest Organizer.
Chance of Winning
The odds of winning the Prize will depend on the number of eligible entries received during the Contest Period.
Verification. Entries are subject to satisfactory verification by the Contest Organizer, in its sole and unfettered discretion. Any entry form which is incomplete, incomprehensible, inaudible, illegible, fraudulent, mutilated, altered, contains false information, is not received within the Contest Period, or otherwise does not conform to the Contest Rules, will automatically be rendered invalid and will disqualify such entrant from being eligible for the Prize. The Contest Organizer reserves the right, in its sole and unfettered discretion, to disqualify any person or cancel one or more entries of any person participating in this Contest or trying to participate by means contrary to the Contest Rules or in a manner which the Contest Organizer, in its sole and unfettered discretion, determine is unfair to other participants (e.g.: use of an Entry Form obtained from an unauthorized source, entries exceeding the limit allowed, computer hacking, etc.). Any attempt to tamper with the entry process, interfere with the Contest Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, is a violation of criminal and civil laws, and the Contest Organizer reserves the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying participants from this and future Contests. Such person may also be referred to the appropriate governmental authorities.
Non-Compliance/Eligibility. If a participant is not in compliance with the Contest Rules, the Contest Organizer reserves the right, in its sole and unfettered discretion, to disqualify such entrant from the contest.
Refusal of a Prize. The verbal or written refusal by a potential or declared winner to accept any prize awarded in accordance with the Contest Rules releases and forever discharges the Contest Organizer and its agents of all obligations related to the Prize, including, but not limited to, delivery thereof.
Liability Limit – Use of Prize. Each entrant and any potential or declared winner releases the Contest Organizer, its subsidiaries, affiliates, their parent organizations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (together, the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest, or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the form of release a winner must execute before receiving the Prize. In the event that the potential winner does not comply with all the provisions as contemplated in the Contest Rules, Contest Organizer shall have the right to disqualify the potential winner, and the Contest Organizer shall be fully and completely released and discharged from any liability or responsibility in this regard.
Liability Limit – Management of the Contest. The Beneficiaries are not liable for any obstruction or closure of the Building, or other limited availability of tours thereof; faulty computer components, software or links; the loss or non-existence of communications capability; or faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult or render a user unable to enter the Contest; problems with any website or website feature, howsoever caused, the malfunction of or damage caused to, any telephone or network lines, computer equipment, data or software, online systems, servers or access providers; or the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”. The Beneficiaries are not liable for any harm participants may suffer directly or indirectly as a result of downloading any webpage or software or transmitting any information related to entry in the Contest. Further, the Beneficiaries assume no responsibility for entries lost, stolen, delayed, damaged or misdirected.
Building and Contest Access. The Beneficiaries do not guarantee access to the Building or non-interruption of tours of the Building during the Contest Period.
Modification. The Contest Organizer reserves the right, in its sole and unfettered discretion, to cancel, terminate, modify or suspend this Contest, or the Contest Rules, in whole or in part, without further notice, in any situation, including, but not limited to, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the management of the Contest as provided in the Contest Rules.
Limit of Prizes. In no event shall the Beneficiaries be obligated to award prizes or damages other than the Prize.
Impossibility to Act – Labour Dispute, etc. The Beneficiaries shall not be responsible for any damages for a failure to operate the Contest in accordance with these Contest Rules in any case, including, but not limited to, where their incapacity to act results from circumstances or a situation beyond their reasonable control or because of a strike, lock-out or any other labour dispute in their company, or those of businesses who’s services are used for holding this Contest, war, riot, insurrection, earthquake, terrorism, civil commotion, fire, flood, accident, destruction or obstruction of the Building, storm or any other act of nature.
Liability Limit–Participation. Any person who participates or tries to participate in this Contest releases the Beneficiaries from any and all liability for damages which he/she could suffer from participating or trying to participate in this Contest.
Authorization re Personal Information. By entering this Contest, each potential winner consents to the Contest Organizer, Beneficiaries and their representatives to collect, use and/or disclose, in their sole and unfettered discretion, and if required, any personal information (as such term is defined in the personal information protection legislation of the Province in which a participant resides, as amended, including, but not limited to, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice, without compensation or further participant consent whatsoever, and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant by the Contest Organizer, in its sole and unfettered discretion. Before being awarded the Prize, the potential winner will be required to sign and return within the time stipulated by the Contest Organizer a form stating that, among other things, he/she has read and understood the Contest Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Organizer and/or similar matters, authorizes the Contest Organizer to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize, accepts the Prize as offered.
Property of Entries. Entry forms are the sole property of the Contest Organizer and at no time will be returned to participants.
Personal Information. Subject to the above provisions or the participant’s consent otherwise provided, participants’ personal information that is collected in this Contest will be used solely by the Contest Organizer, and their representatives, for the administration of the Contest.
Decisions of the Contest Organizers. All decisions of the Contest Organizer, or those of their representatives, regarding this Contest are final and binding.
Enforceability Severability. If a section of these Contest Rules is declared or ruled by a court of law as illegal, unenforceable or void, that section will be deemed void, but all other sections not affected will be enforced as allowed by law.
Jurisdiction and Forum. The Contest is subject to all applicable federal, provincial and municipal laws and regulations, and participants irrevocably attorn to the jurisdiction of the courts in the City of Calgary, in the Province of Alberta in the event of any legal dispute arising in connection with the Contest.Contest Rules Govern. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
